Terms of Service

This Contract applies to both registered Members and unregistered Visitors.

When you register and join Skillbourg, you become a “Member.” If you have not registered, you may access certain features of the Service as a “Visitor.” This Contract applies to both Members and Visitors. Certain features are available only to Members.

Skillbourg connects candidates with employers using AI-powered recruitment tools.

Skillbourg is an AI-powered recruitment marketplace that connects job candidates with employers. The Service uses artificial intelligence to generate candidate profiles, provide job matching, and facilitate recruitment. Recruiters may browse candidate profiles, including through talent discovery (see Section 9 for your right to withdraw consent).

You will keep your credentials secure and your information accurate. You are responsible for activity on your account.

Eligibility

You must be at least 18 years old to create an account.

Account Security

You agree to: (1) use a strong password and keep it confidential; (2) not share or transfer your account to anyone else; and (3) comply with these Terms and all applicable laws. You are responsible for all activity on your account unless you close it or report misuse.

Accurate Information

You agree to provide and maintain true, accurate, and complete information. You agree to keep your contact information up to date.

Some profile fields are generated automatically by AI. You have the right to rectification of any inaccurate data — contact gdpr@skillbourg.com.

Your account belongs to you.

You own your content. You grant us a licence to use it to provide the Service. Content that includes personal data is subject to our Privacy Policy.

Your Ownership: You retain full ownership of all content you submit.

Licence to Us: You grant us a non-exclusive, royalty-free licence to use, process, store, and display your content solely to operate and provide the Service, including sharing your profile with recruiters through the platform. This licence ends when your account and data are permanently deleted in accordance with Section 7.

You and RMT Labs S.A. agree that where content includes personal data, it is subject to our Privacy Policy. You agree that we may access, store, process, and use any information you provide in accordance with the terms of the Privacy Policy and your choices.

By submitting suggestions or other feedback regarding the Service, you agree that RMT Labs S.A. may use such feedback for any purpose without compensation to you.

Your profile may be visible to recruiters and other users depending on how you use the Service. You can object to certain visibility.

The Service allows information to be shared in several ways. When you apply for a job, your profile is shared with that employer’s recruiters. Recruiters may also browse candidate profiles through talent discovery if you have opted in (you may withdraw this consent at any time — see Section 9).

Once a company accesses your data outside the platform, they become an independent data controller for any data they process outside of Skillbourg (see Section 10).

We are not obligated to publish any content on the Service and may remove content at our discretion, subject to applicable law.

You agree to receive notices from us through the Service or via your contact information. Keep your details up to date.

You agree that we will provide notices and messages to you: (1) within the Service, or (2) via the contact information you provided (e.g., email). You agree to keep your contact information up to date. If your contact information is out of date, you may miss important notices.

You can delete your account at any time. We retain your data briefly to allow reactivation, then permanently delete it.

Deletion by You

You may delete your account at any time using the delete account option in the platform. Your profile will be immediately hidden from all other users. Data is retained for a 30-day grace period to allow reactivation, after which all personal data is permanently deleted. For immediate permanent deletion, contact gdpr@skillbourg.com.

Inactive Accounts

If your account has been inactive for 24 months, we will notify you by email. If you do not respond within 30 days, your account and associated data will be permanently deleted.

Data Accessed by Recruiters

We cannot retrieve or delete data that a recruiter may have downloaded or stored outside our platform. The recruiting company is an independent data controller for any data they process outside of Skillbourg (see Section 10).

Termination by Us

If you violate these Terms, we will notify you and provide 14 days to remedy the violation. If the violation is not remedied, we may suspend or terminate your account. We may suspend or terminate your account immediately and without prior notice in cases of serious misconduct, including fraud, discrimination, security threats, or illegal activity. Your data subject rights under GDPR are not affected by account termination.

We use AI to support recruitment. AI is advisory only — humans make all hiring decisions. You have rights regarding automated profiling.

The Service uses artificial intelligence to generate candidate profiles, match candidates to job postings, and support recruitment decisions. All AI processing takes place within the European Union.

Human Oversight: AI is advisory only. Recruiters make all shortlisting and hiring decisions. No candidate is automatically excluded from consideration.

Your Rights: Our use of AI constitutes profiling under GDPR Art. 4(4). You have the right to request human review, express your point of view, object to profiling, and contest decisions influenced by automated processing. See our Privacy Policy for full details. You have rights over your personal data, including the right to withdraw consent and to control how we use it. See our Privacy Policy for full details.

Your personal data is processed in accordance with our Privacy Policy and Cookie Policy, which provide full details on data collection, use, sharing, retention, and your rights. You acknowledge that you have read our Privacy Policy.

Key Rights: You have the right to access, correct, delete, restrict, and port your personal data, to object to certain processing (including profiling), and to withdraw consent at any time. See our Privacy Policy.

Talent Discovery: You may withdraw your consent to talent discovery at any time via your profile settings or by contacting gdpr@skillbourg.com.

Companies that access candidate data through the platform must comply with data protection law and use the data only for recruitment.

When companies access candidate data through the platform, they become an independent data controller for any personal data they process outside of it. By using the Service, companies and recruiters agree to:

• Comply with GDPR and all applicable data protection laws.
• Process candidate data only for legitimate recruitment purposes.
• Not discriminate against candidates on the basis of any protected characteristic.
• Implement appropriate security measures to protect candidate data.
• Delete candidate data when no longer needed for the recruitment purpose.
• Report any suspected data breach involving candidate data to gdpr@skillbourg.com without undue delay.

Violation may result in suspension or termination of access.

The Service belongs to RMT Labs S.A. You may not copy, distribute, or misuse our intellectual property.

Our Property

The Service and its original content, features, and functionality are the exclusive property of RMT Labs S.A. and its licensors. All rights reserved.

Third-Party Property

All third-party trademarks, logos, and company names remain the property of their respective owners.

Copyright Complaints: If you believe content on the platform infringes your intellectual property rights, contact gdpr@skillbourg.com with details of the copyrighted work, its location, and your contact information.

Use Skillbourg for legitimate recruitment purposes. Respect other users, the law, and our platform.

You WILL:

• Comply with all applicable laws, including privacy laws, intellectual property laws, anti-discrimination laws, and all other applicable regulations.
• Provide accurate identity and contact information and keep it updated.
• Use your real identity on your profile.
• Use the Service only for legitimate recruitment purposes.
• Treat all users with respect and professionalism.

You WILL NOT:

• Create a false identity, misrepresent your identity, create a profile for anyone other than yourself, or use or attempt to use another person’s account.
• Use the Service to discriminate against any person on the basis of any protected characteristic.
• Upload content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
• Develop, support, or use software, devices, scripts, robots, or any other means or processes to scrape or copy the Service or its data.
• Override any security feature or bypass or circumvent any access controls or use limits of the Service.
• Copy, use, display, or distribute any information obtained from the Service without authorisation.
• Disclose information that you do not have the right to disclose, including confidential information of others.
• Violate the intellectual property or other rights of RMT Labs S.A. or any third party.
• Post or share anything that contains software viruses, worms, or any other harmful code.
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, or data models of the Service.
• Imply or state that you are affiliated with or endorsed by Skillbourg without our express written consent.
• Rent, lease, loan, trade, sell, or otherwise monetise the Service, its data, or access to it.
• Use bots or other unauthorised automated methods to access the Service, create accounts, send messages, or drive inauthentic engagement.
• Frame, mirror, or otherwise simulate the appearance or function of the Service.
• Interfere with the operation of, or place an unreasonable load on, the Service.
• Use the Service to do anything that is unlawful, misleading, discriminatory, fraudulent, or deceitful.
• Misuse any reporting, complaint, or appeals process.

We may change, limit, or discontinue features of the Service. Skillbourg is not a storage service.

We may change, suspend, or discontinue any part of the Service. We may also limit the availability of features so that they are not available to all Members or Visitors.

Skillbourg is not a storage service. We have no obligation to store, maintain, or provide you with a copy of any content or information that you or others provide, except to the extent required by applicable law — including your data protection rights under the GDPR — and as described in our Privacy Policy.

The Service is provided “as is.” We limit our liability to the extent permitted by law. These limitations do not apply to fraud, gross negligence, or data protection breaches.

14.1 Disclaimer of Warranty

RMT LABS S.A. MAKES NO REPRESENTATION OR WARRANTY ABOUT THE SERVICE, INCLUDING ANY REPRESENTATION THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, AND PROVIDES THE SERVICE ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RMT LABS S.A. DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF TITLE, ACCURACY, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE.

14.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RMT LABS S.A. SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST BUSINESS OPPORTUNITIES, LOSS OF DATA, OR REPUTATIONAL HARM, ARISING FROM YOUR USE OF THE SERVICE.

14.3 Exclusions

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY FOR: (A) FRAUD, WILFUL MISCONDUCT, OR GROSS NEGLIGENCE; (B) DEATH OR PERSONAL INJURY; (C) BREACHES OF APPLICABLE DATA PROTECTION LAW; OR (D) ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER LUXEMBOURG LAW OR MANDATORY EU CONSUMER PROTECTION LAW.

14.4 AI Outputs

AI outputs are not guaranteed to be error-free and are not substitutes for human judgement.

Luxembourg law governs these Terms. EU consumers retain the right to use their home courts.

These Terms are governed by Luxembourg law. To the extent permitted by applicable law, disputes shall be submitted to the competent courts of Luxembourg City. For EU consumers: you retain the right to bring proceedings in the courts of your country of habitual residence, and mandatory consumer protection laws of your country of residence apply per EU Regulation 593/2008 (Rome I), Article 6.

We may update these Terms. We will give you notice of material changes. Changes are not retroactive.

We may modify these Terms, our Privacy Policy, and our Cookie Policy from time to time. For material changes, we will notify you through the Service or by email at least 30 days before changes take effect, to give you the opportunity to review the changes. Changes are not retroactive.

We may not always provide prior notice of changes: (1) when those changes are required by law to take effect immediately, or (2) when those changes relate to a newly launched feature of the Service.

If you object to any changes, you may delete your account (see Section 7). Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from events beyond our reasonable control, including but not limited to natural disasters, infrastructure failures, regulatory actions, or changes in law.

If any provision of these Terms is found to be invalid or unenforceable by a competent court, the remaining provisions shall continue in full force and effect.
